Terms of Service

1. About these Terms

These Terms govern your use of the jet-supply.com website (the "Website") and the brokerage services provided by Roksana Jujka, operating under the business name Jet Supply, a sole proprietorship registered in Poland (CEIDG, NIP 7322208939, REGON 522519991, registered address Henryka Sienkiewicza 85/87, 90-057 Łódź) (the "Broker", "we", "us", "our").

By using the Website or requesting a quote, you ("you", "the Client") agree to these Terms.

These Terms are also available in Polish at /pl/regulamin/. In the event of any inconsistency between the English and Polish versions, the Polish version prevails.

2. Definitions

  • Broker — Roksana Jujka, operating under the business name Jet Supply, as defined above.
  • Operator — the holder of a valid EASA Air Operator Certificate (AOC) who actually operates the aircraft and carries the Client and any passengers.
  • Flight — an air transport service (private jet, air ambulance, or helicopter) operated by an Operator and arranged by the Broker on behalf of the Client.
  • Quote — a non-binding proposal prepared by the Broker following a Client enquiry, setting out aircraft options and indicative pricing.
  • Charter Contract — the binding contract for the operation of a Flight, concluded between the Client and the Operator. The Broker is not a party to the Charter Contract.
  • Brokerage Services — the services provided by the Broker in arranging, coordinating and facilitating Flights, as described in Section 3 below.
  • Website — jet-supply.com and all its subpages.

3. The Broker's role

The Broker is an aviation brokerage. The Broker arranges Flights between Clients and Operators. The Broker does not own aircraft, does not hold an Air Operator Certificate, does not operate Flights, and is not a carrier under the Montreal Convention or any other applicable international aviation convention. The Broker's role consists of:

(a) receiving and clarifying the Client's requirements;

(b) sourcing suitable aircraft from a network of Operators holding valid EASA Air Operator Certificates;

(c) presenting one or more Quote options to the Client;

(d) facilitating the conclusion of the Charter Contract between the Client and the chosen Operator;

(e) coordinating ancillary services (catering, ground transport, FBO handling, permits) as agreed;

(f) acting as a single point of contact between Client and Operator before, during and after the Flight.

The Broker is not responsible for:

(i) the safety, condition or airworthiness of the aircraft — these are the Operator's responsibility under their AOC;

(ii) the conduct of the flight crew or the operational decisions made during the Flight;

(iii) delays, diversions, cancellations or other operational events that arise from the Operator's conduct of the Flight or from factors outside the Broker's reasonable control (weather, ATC restrictions, slots, force majeure);

(iv) the Operator's compliance with its own contractual or regulatory obligations.

4. The booking process

(a) Enquiry. The Client submits a quote enquiry through the Website, by email or by telephone.

(b) Quote. The Broker reviews availability with Operators in its network and provides a written Quote setting out aircraft options, indicative pricing, and any material conditions. Quotes are non-binding offers to negotiate and are valid for the period stated, or — if not stated — for 24 hours from issuance, subject to confirmed availability at the time of acceptance.

(c) Acceptance. The Client accepts a Quote in writing (email is sufficient).

(d) Charter Contract. Once the Client accepts a Quote, the Broker arranges the Charter Contract directly between the Client and the chosen Operator. The Charter Contract sets out the binding terms of the Flight itself, including the Operator's own conditions of carriage, cancellation policy, and liability. The Client should read the Charter Contract carefully.

(e) Deposit and payment. A deposit or full payment is typically required to confirm the booking. The exact amount, schedule and method are set out in the Quote and the Charter Contract. Payment terms follow the Operator's requirements.

(f) Flight. On the day of the Flight, the Client deals with the Operator and the FBO directly for check-in and embarkation. The Broker remains reachable throughout.

5. Pricing

Quotes are itemised and explained. Pricing reflects aircraft category, route, lead time, repositioning, ground services and applicable taxes and surcharges. The Broker discloses all material elements of the price before the Client commits.

The Broker may charge a brokerage fee, which is included in the total price unless separately stated.

Prices and indicative ranges shown on the Website are estimates only and do not constitute an offer. The binding price is the one set out in the Quote accepted by the Client and confirmed in the Charter Contract.

6. Cancellation and changes [REVIEW]

Cancellation terms are set primarily by the Operator's Charter Contract and depend on the aircraft type and how close to departure the cancellation occurs. The Broker will set out the applicable cancellation terms in the Quote and in the Charter Contract before the Client commits.

The Broker's own brokerage fee, if separately invoiced, is non-refundable once the Charter Contract has been concluded with the Operator.

Changes to a confirmed booking (route, timing, passenger count) are accommodated where operationally feasible. The Broker will communicate any cost or feasibility implications before changes are made.

7. The Client's obligations

The Client agrees:

(a) to provide accurate and complete information about passengers, baggage, intended cargo, pets, and any special requirements at the time of booking;

(b) to ensure that all passengers hold valid travel documentation (passport, visa, health certifications) as required for the route;

(c) to comply with the Operator's conditions of carriage and the lawful instructions of the flight crew and ground staff;

(d) to make payment in accordance with the agreed schedule;

(e) not to use the Brokerage Services for any unlawful purpose or for the transport of prohibited goods.

The Broker may refuse to arrange any Flight where the Client's purpose appears unlawful, unsafe, or contrary to the Broker's policies on integrity and sanctions compliance.

8. Air ambulance — additional terms

For air ambulance Flights, the Broker arranges the aircraft and coordinates with the Operator's contracted medical crew (typically a physician and a flight nurse). The Broker is not a medical provider, does not provide clinical care, and does not assume responsibility for medical decisions or outcomes, which remain the responsibility of the Operator's medical team and the sending and receiving medical facilities.

The Broker will arrange ground ambulance coordination, cross-border medical clearances and the documentation required for medical transport, working with the Operator and the relevant facilities.

9. Helicopter — additional terms

For helicopter Flights, off-airport landings depend on the landing site meeting legal and safety requirements (adequate dimensions, clear approach, landowner consent, applicable permits). Where the proposed landing site does not meet these requirements, the Broker will, with the Operator, propose the nearest qualifying alternative. Final acceptance of any landing site rests with the Operator and the pilot in command.

10. Force majeure

Neither the Broker, the Client nor the Operator is liable for failure to perform obligations under these Terms or the Charter Contract where such failure results from force majeure, including but not limited to severe weather, ATC restrictions, airport closures, strikes, civil or military action, pandemic-related restrictions, acts of terrorism, or other events outside the affected party's reasonable control.

Where a Flight is prevented by force majeure, the parties will work in good faith to reschedule or to apply refund or credit terms as set out in the Operator's Charter Contract.

11. Liability [REVIEW]

The Broker's liability to the Client is limited as follows:

(a) The Broker is liable for the diligent performance of its Brokerage Services as defined in Section 3. The Broker is not liable for the conduct of the Flight itself, which is the responsibility of the Operator.

(b) The Broker's aggregate liability to the Client under or in connection with these Terms, regardless of the cause of action, is limited to the brokerage fee actually received by the Broker for the booking giving rise to the claim, except where Polish law expressly excludes such limitation.

(c) The Broker is not liable for indirect, consequential or punitive damages, including loss of profits, loss of opportunity or loss of reputation.

(d) Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Polish law, including liability for wilful misconduct or gross negligence.

(e) Claims against the Operator for incidents arising during the Flight (including delay, damage, injury or loss) lie against the Operator under the Charter Contract and applicable aviation law, including the Montreal Convention and Regulation (EC) 261/2004 where applicable.

12. Personal data

The Broker processes personal data in accordance with RODO and the Privacy Policy. By using the Brokerage Services, the Client acknowledges receipt of the Privacy Policy.

13. Intellectual property

The content of the Website (text, design, imagery, layout, code) is owned by or licensed to the Broker and is protected by Polish and international copyright. The Client may not reproduce, distribute or create derivative works from the Website's content without the Broker's prior written consent, except for personal, non-commercial reference.

The Jet Supply name and any associated logos are trademarks of the Broker. Use without permission is prohibited.

14. Confidentiality

The Broker treats Client information as confidential and shares it only with the Operator and the service providers necessary to deliver the booked Flight, or where required by law.

15. Complaints

Complaints regarding the Brokerage Services should be sent to sales@jet-supply.com. The Broker will acknowledge receipt within 5 working days and respond substantively within 30 days. Complaints regarding the conduct of the Flight itself should additionally be addressed to the Operator under the Charter Contract.

Consumer Clients in Poland may also use the online dispute resolution platform of the European Commission at ec.europa.eu/consumers/odr or refer matters to the President of UOKiK (Urząd Ochrony Konkurencji i Konsumentów) or other consumer-protection bodies.

16. Changes to these Terms

The Broker may update these Terms from time to time. Updates take effect from the date of publication on the Website. The version in force at the time of each Quote applies to that Quote and any resulting booking.

17. Governing law and jurisdiction [REVIEW]

These Terms are governed by Polish law.

For Clients who are consumers (in the meaning of the Polish Civil Code), nothing in this clause restricts the jurisdiction available under the Polish Code of Civil Procedure and Regulation (EU) 1215/2012 (Brussels I recast); the consumer may bring proceedings in the courts of their place of residence.

For Clients who are not consumers, any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts competent for the registered office of the Broker (Łódź, Poland).

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force.
